Court Clinic Services Offered
Pursuant to NM Stat § 40-12-5 (2020), a “judicial district may establish a domestic relations mediation program by court rule approved by the supreme court. The district court may employ or contract with a counselor to provide consultations, evaluations and mediation in domestic relations cases involving children.” Court Clinic services are only accessed through a court order.
Mediation
Mediation is a confidential process in which parties meet with a Court Clinician “in order to assist the parties in focusing on the needs of the children and to assist in reaching a mutually acceptable parenting plan regarding the child.” Parenting plans and other mediated agreements, typed and filed by the Court Clinic, are the work products of successful mediations.
Consultations
The Court Clinic conducts different levels of assessments, which are called Consultations. The information gathered during a consultation is provided via testimony at a hearing, allowing parties, counsel and the Court to question the Court Clinician.
On Call Consultation
The Court Clinic provides limited consultation services when more immediate assistance is required.
Brief Consultation
The Court Clinic provides brief consultation services based upon specific referral questions and identified issues for cases where less immediate assistance is required.
Scheduled Consultation
The Court Clinic provides more extensive consultation services based upon specific referral questions and identified issues for cases that have multiple and/or chronic issues, but do not require immediate assistance.
Advisory Consultation
Currently infrequently available because of the lack of psychological testing, a key component of an Advisory Consultation. Acceptance of referrals is determined in consultation with the Family Court Presiding Judge.
